PGCB files order stating reasons Foxwoods license was pulled

The Pennsylvania Gaming Control Board has issued a written order, following up on its  Dec. 16 vote to rescind the Class 2 slots license it granted Philadelphia Entertainment and Development Partners in 2006.

The board still has not issued a written adjudication, a document that will outline the reasons for its decision in greater detail. And it is this document that PEDP attorney Fred Jacoby said the casino concern needs to review before determining whether to appeal the board's 6-1 decision.

Media outlets received this email from Jacoby Monday. "We just found out by our inquiry of the Board today that this was filed late in the day Thursday, before the Holiday on Friday.  We only learned of it today when we inquired as to the Board's intentions and time schedule for entering their Order.  They advised that they had sent it to us by certified mail, which is what the statute required."
Doug Sherman, the board's chief counsel, said after the board made its decision to revoke the license that his office believes any appeal would go through Commonwealth Court, but he knows there are differences of opinion on that. Other matters relating to casinos have gone straight to state supreme court.
