Somerton couple fights charges filed for sending daughter to Montco school

A Somerton couple is giving up the fight that began last summer when they were charged with faking their residency to send their daughter to school in Montgomery County.

Hamlet and Olesia Garcia now have an attorney from Miami who says the couple’s arrest was racially motivated.

They were charged for costing the Lower Moreland School District more than $10,000 after a surveillance detail determined their child was not living at a grandparent’s address in Montgomery County, but appeared to live on Philmont Terrace in Somerton. The Garcias say the child was living in Montgomery County when they separated and that they did not pull her from that school when the reconciled.

The case has been continued for 90 days.
